Cherry Hill Township (“Township”) Council has approved on first reading by title only an ordinance repealing and replacing Chapter XXI of the Township’s General Ordinances currently entitled “Trees.” The new Ordinance entitled “Regulation of Trees” is still located in Chapter XXI of the Township’s General Ordinances and provides a new framework for the review and approval of tree removal within the Township, requires onsite replanting or contributions to the newly established tree fund, and expands liability and penalties for illegal tree removal. In lieu of publication of the entire Ordinance and in accordance with N.J.S.A. 40:49-2, a brief summary is hereby provided as to the main objectives and/or provisions of the Ordinance.

The Ordinance will require onsite tree replacement, on a “one-for-one” basis, for all trees removed by commercial and residential applicants, except that residential applicants may remove up to three (3) trees per year without any replacement requirement, and the removal of dead trees will not require tree replacement by either commercial or residential applicants. 申请人可向新成立的樱桃山树基金捐款，以代替现场更换，商业申请人每棵树300美元，住宅申请人每棵树175美元。 樱桃山树木基金是一项新的基金，专门用于在整个乡镇购买和种植树木，以及维护和清除公共财产上的树木。
The definition of a “person” has been expanded to include, among others, owners, tenants, occupants, businesses, corporations, including contractors, so that in the event illegal tree removal occurs, all responsible parties may be issued a summons to court. Similarly, the penalties have been amended/expanded so that in the event a “person” is found guilty of violating the Ordinance, in addition to the monetary penalty imposed by the municipal court judge, the “person” will also be required to replant all illegally removed trees on their property or contribute $300.00 for each tree removed to the Cherry Hill Tree Fund.
